The Railroad Commission of Texas recently unveiled a draft of the revised rule at a meeting, inviting public commentary. The proposed regulation covers various waste disposal sites and aims to promote recycling of drilling wastewater.

The need for updated rules stems from the rapid changes in the industry due to fracking, which has significantly increased waste volume and altered its composition. Despite improvements in the current draft, concerns from both environmental groups and industry stakeholders persist.

The proposed regulation presents a mix of strategies to safeguard groundwater, encompassing enhanced monitoring, design controls, and closure standards.

Key Highlights of the Proposed Rule

During drilling operations, unique waste streams like mud and cuttings resurface for disposal in earthen pits. While authorized pits face fewer restrictions, commercial waste pits demand individual permits and adhere to more stringent guidelines.

The proposed rule also addresses commercial recycling facilities and produced water recycling sites, recognizing the growing volume of waste generated in the Permian Basin alone.

Waste pits, if improperly constructed, pose a significant threat to groundwater contamination. The commission’s records indicate multiple violations in recent years, underscoring the need for stricter oversight and regulatory clarity.
