The Launch of Venu Sports Delayed Due to Legal Battle with FuboTV
Exciting plans for the launch of Venu Sports have hit a roadblock as a federal judge recently granted FuboTV’s motion for a preliminary injunction against the collaboration between ESPN, Fox, and Warner Bros. Discovery.
In her detailed 69-page ruling, U.S. District Judge Margaret M. Garnett of the Southern District of New York expressed that Fubo was likely to succeed in proving that the joint venture would violate antitrust laws, leading to irreparable harm for Fubo and consumers.
Despite the setback, ESPN, Fox, and Warner Bros. Discovery have declared their intention to appeal the ruling, showing their determination in pursuing the launch of Venu Sports.
The legal battle began after FuboTV filed a lawsuit following the announcement of a sports streaming service by the media giants. FuboTV has long desired to offer a sports-only streaming service but claims it has been hindered by bundling requirements imposed by ESPN, Fox, and Warner Bros. Discovery.
Following the ruling, FuboTV’s co-founder and CEO, David Gandler, expressed satisfaction, emphasizing the importance of a fair and competitive marketplace for consumers. Gandler reiterated Fubo’s commitment to advocating for equal treatment and a level playing field.
The highly anticipated Venu Sports platform, initially scheduled to launch at $42.99 per month in the fall, promised a robust lineup of 14 linear networks, including popular channels like ESPN, FOX, and TNT, along with the option to bundle with services like Disney+ and Hulu.
In response to the ruling, ESPN, Fox, and Warner Bros. Discovery released a joint statement defending Venu Sports as a pro-competitive option aimed at enhancing consumer choice in the streaming market.
With an equal share in the joint venture, cable and satellite companies are closely monitoring the outcome, considering the implications for their bundling requirements and subscriber fees.
