NEW YORK – Disney is changing its stance on a wrongful death lawsuit in Florida after facing criticism for trying to dismiss it based on a Disney+ subscription agreement.
The company announced its decision to withdraw the motion and allow the lawsuit to proceed in court. This significant shift comes after Disney came under fire for arguing that the victim’s family had waived their right to sue after signing up for Disney+.
Chairperson of Disney’s theme park division, Josh D’Amaro, emphasized the company’s commitment to prioritizing compassion in his statement. He acknowledged the unique circumstances of the case and expressed a desire to expedite a resolution for the grieving family.
Initially, Disney contended that the husband of the victim, Jeffrey Piccolo, had waived his right to sue when he signed up for Disney+. However, Piccolo’s lawyers disputed this claim, calling it “absurd” to suggest that all Disney+ subscribers had relinquished their legal rights.
The lawsuit stems from a tragic incident at an Irish pub in Disney Springs where Dr. Kanokporn Tangsuan suffered a fatal allergic reaction. Despite assurances that her food was allergen-free, Tangsuan tragically passed away due to anaphylaxis.
Disney’s decision to forego arbitration and allow the lawsuit to proceed reflects a more empathetic approach to resolving the family’s loss. The case is expected to move forward in court, with both parties preparing to present their arguments.
