Lawsuit filed against Northside ISD, officers by woman shot at Dub Farris Complex

SAN ANTONIO – A shocking incident unfolded outside the Dub Farris Athletic Complex, leading to a lawsuit against the Northside Independent School District and two of its officers. Let’s dive into the details of this alarming case.

The lawsuit, filed recently, alleges that Northside ISD, along with NISD Officer Kyle Kennedy and NISD Officer Joseph Garcia, overstepped their boundaries by resorting to deadly force in a situation that could have been handled differently.

It was a regular day at Farris Stadium until chaos erupted around 1:30 p.m. on Oct. 28, 2023, just before a high school football game between O’Connor High School and Sotomayor High School. Markay Garcia, the victim in this case, found herself in a dangerous confrontation with the district officers.

According to reports, the situation escalated when Garcia, trying to park her vehicle, encountered Officers Kennedy and Garcia. What followed next was a sequence of events that resulted in a tragic shooting, leaving Garcia injured and seeking justice through legal channels.

Fast forward to the aftermath of the incident, where Garcia, having sustained a gunshot wound to her arm, was rushed to a local hospital for treatment. The repercussions of the officers’ actions were severe, prompting Garcia to rightfully challenge the violation of her constitutional rights.

The lawsuit sheds light on the district’s negligence in hiring Officer Kennedy despite a checkered past, raising questions about the screening process for law enforcement personnel within educational institutions.

Garcia’s presence at the athletic complex that day was purely to support her husband, an assistant coach for the Sotomayor football team. What should have been a routine trip to watch a football game turned into a nightmare due to the actions of the officers.

The lawsuit vividly describes the moments leading up to the shooting, highlighting the lack of clarity in the officers’ instructions and the disproportionate response that followed. Garcia’s innocence in the entire ordeal is emphasized, pointing towards the unjustifiable use of deadly force against her.

As the legal battle unfolds, Garcia seeks not just compensation for her physical and emotional trauma but also a fair trial to hold the responsible parties accountable for their actions.

While the district remains silent on the matter, the wheels of justice continue to turn, bringing to light the need for greater accountability and transparency in such cases.
